Witness states that he is filing a statement today and that may be treated as his examination in chief. (The statement is taken on record and marked as Annexure – 'A' to his statement and same shall be treated as his examination –in - chief).

Cross examination by S.S. Gandhi, Senior Advocate on behalf of Delhi Police

It is not true that SI Babu Lal, SI Sumer Singh along with the staff had come to our locality at 12'O clock. They had come at about 2.00 pm There is no picket of Home Guards in our locality. It is not true that the Home Guards, who were posted there, were attacked by some Sikhs with swords and other weapons. It is not true that these police officers had come there after the attack on the Home Guards and that they had taken into custody 16 persons and had also seized their weapons.

We were about 50 Sikhs and some of us had sticks in our hand. We were standing there for defending ourselves. It is not true that we were all taken into custody together. We were taken into custody from different places at different times. It is not true that we were taken to the ESI Hospital for medical examination.

It is true that I and my two brothers refused to get ourselves medically examined. Others who refused to get medically examined were Mahinder Singh, my father, Sureinder Singh and another Mahinder Singh. I do not know if Piyara Singh, Dharam Singh and Rattan Singh were medically examined or not. They were taken into custody from Chokhandi which is about 2 Kms. away from my house. [Mr Gandhi states that all of them were arrested in the same case and that case is FIR No. 443/84.] Mr Harjeet Singh who was also medically examined is my brother.

It is true that a charge sheet was also filed in that case by the police. The distance between my house and FC – 121, Tagore Garden will be about 3 to 4 Kms. It is not true to say that the distance between my house at Tilak Nagar and Tagore Garden is about 1 Kms. It may be about 1 Km. away from Tilak Nagar Police Station but distance between my house and main road Tilak Nagar itself is 1 Km.

It is true that we were taken to Tihar Jail under the orders of Magistrate. I had not given any application to the Magistrate nor had filed any complaint in the court that I and my relatives were beaten by the police. In Tihar Jail we were medically examined. I had not filed any complaint even after I was released on bail.

I was not medically examined when I was admitted in Tihar Jail. My brother was medically examined and he had at that time told doctor that he was beaten by the police and that his hand was broken by the police. I had not filed any affidavit before any Commission or any other authority prior to giving statement today.
