1984 Affidavits

Affidavit submitted before the Nanavati Commission

I, Sukhdev Singh, S/o S. Siria Singh, aged 80 yrs., R/o Village Khera Jatta, Police Station Dhuri, P.O. Amar Garh, Distt. Sangroor, Punjab, do hereby solemnly affirm and declare as under:-

1. That at the time of riots in Oct./Nov.'84, I was residing in Punjab and my son Late S. Sohan Singh was a driver and was working in Delhi.

2. That my son late Sohan Singh went to Gulabi Bagh Market on 1-11-84, for the repair of his vehicle along with other friends.

3. That an enquiry was made by my other son S. Joginder Singh brother of late Sohan Singh. But failed to know the whereabouts of my son and his brother.

4. That on 14-11-84, a complaint was lodged by S. Joginder Singh at Police Station Gulabi Bagh that S. Sohan Singh, Kulwant Singh and Jagpal Singh alias Pal Singh are missing since 1-11-84. A copy of said complaint dated 14-11-84 which was registered as report No.5 along with its English Translation is annexed herewith as ANNEXURE-'A'.

5. That my son was sole bread earner in my family and he was used to send us money out of his savings to us. I and my wife both are 80 yrs. old aged and having no other means of earning except to work in field at this age.

6. That I have received no compensation from any Govt. i.e. neither from Punjab Govt. or Delhi Govt.

7. That since my son was killed in Delhi. Delhi Govt. was bound to pay me compensation, but I have not been paid any compensation so far.

8. That the Delhi Govt. pursuant to orders passed by High Court of Delhi to pay the enhanced compensation of Rs.3,50,000/- to the riot victims for each death during the riots and Rs.3,30,000/- to those persons who have been already paid Rs.20,000/- as compensation invited the application from riot affected families.

9. That the deponent also submitted an application for the grant of compensation along with all relevant documents to the Commissioner Relief at Tis Hazari, New Delhi.

10. That after the submission of application, deponent was called by the Sub Divisions Magistrate with original documents. The deponent appeared before the SDM and submitted all the documents.

11. That after few months later, the case of deponent was illegally and arbitrarily rejected by the SDM on the around that deponent was not having proper FIR or death of his son Late Sohan Singh.

12. That the deponent appeared before SDM and stated about the complaint lodged at Police Station Gulabi Bagh on 14-11-84, and SHO, Police Station Partap Nagar vide confirmation letter dated 15-11-96, and 29-11-96, has confirmed that a report of missing has been lodged at Police Chowki Gulabi Bagh which was at that time under Police Station Sabzi Mandi and now fails under Police Station Partap Nagar.

13. That the deponent has been denied the compensation as directed by the Hon'able High Court of Delhi in riot victims case on the ground that deponent does not have death certificate and proper FIR.

14. That as the whereabouts of Sohan Singh, son of deponent, are not known for more than last 15 yrs. to any body including all the family members of the deponent, the deponent is confident that his son Sohan Singh as been killed in 1984 anti Sikh Riots.

15. That I and my wife both are 80 yrs. old, and not in a position to earn my standard livelihood previously I was working in the fields but how, I am not in a position to work in field. My son was sole bread earner for me and my wife.
