Affidavit submitted before the Misra Commission

AFFIDAVIT OF S. SOBHA SINGH SON OF S. ABAL SINGH, AGED 55 YEARS, RESIDENT OF 12/78, KALYANPURI, DELHI.

I, Sobha Singh, the above named Deponent, do hereby solemnly affirm and state as under:-

1. I am the President (Pradhan) of Block No. 12.

2. Yesterday on 22.8.85 at 8.00 a.m., Parsa Singh came and told me that a policeman had come to his house and four/five respectable people had been called to the Police station. We four/ five persons went to the police station. There we were taken to the room of Choudhry Manphool Singh, Sub-Inspector where along with Manphool Singh, Surbir Singh Tyagi, who was S.H.O. during the riots in November, 1984 was present.

3. Tyagi told us to give statement in his favour as he was not at fault. We replied that Police had committed atrocities on us, as we were arrested without any fault. Our arms were snatched away and our houses were looted and then burnt. Tyagi then replied that he had done nothing on his own accord and whatever was done, it was done on the orders of higher authorities.

He further said "Those who brag of being your own, those very officers had issued directions to us, Had he not obeyed, he is being penalized," We than told him that if he intended to arrest us, he could do so, but why did he lodge false cases against us. Then Tyagi replied that that thing was done at the instance of 'Jatav' and other higher officers. He said that those officers have gone now scot free, and he had been involved.

4. When we refused to give statement in his favour, Tyagi said "Today you are in an angry mood, I will talk to you sometime again."

5. We are afraid that if we do not give statement in favour of Surbir Singh Tyagi, policewale will involve us in some other false case.
