1984 Delhi Sikh Genocide - Affidavits

Affidavit submitted before the Misra Commission

I, Kulwant Singh S/o Kartar Singh, R/o H.No. X-329, Raghuvarpura-I, Gandhi Nagar, Delhi-110031, do hereby solemnly affirm and declare as under: -

1. That I am permanent resident of above address for the last so many years.

2. That I am running a business F.P.S. Shop at X-634, Raghuvarpura-I, Gandhi Nagar, Delhi-31.

3. That on 2-11-84, about 10 A.M., I left my house and to go to any shop, While on the way I felt nothing.

4. That on the day when I reached at my shop No.X-684, I saw my landlord Murari Lal s/o Bhundee saying to some gundas that Mr. Kulwant Singh has come by the way Mr. Amrit Lal Gulati told me confidentially that that Mr. Murari Lal was coming with some gundas to loot the shop and they will kill you.

5. That when I saw a mob is coming from Chand Mohalla, immediately I A.M. started closing my shop. The mob reached and threatened me that you must open the shop otherwise we will kill you and cut your hairs.

6. I told the person that I will do according to your will, because I afraid from them, with the help of some neighbours, I ran from there and reached my own house.

7. That the following were in the mob:-

1) Mr. Murari Lal S/o Bhundee, r/o X-684, Raghubarpura-I.

2) Jai Bhagwan S/o Ram Sarup, son-in-law of Murari Lal.

3) Mehar Chand, brother-in-law of Murari Lal.

4) Kalu S/o Hari Chand, nephew of Murari Lal.

5) Rattan Lal, r/o X-681, Raghuvarpura-I.

6) Shyam Lal, r/o 680, Raghuvarpura-I, brother of Rattan Lal.

7) Ram Sarup S/o Puran, r/o X-683, Raghuvarpura.

8) Ram Singh alias Meertia, r/o X-2180, Raghuvarpura.

9) Attar Singh S/o Ram Singh, -----do--------------.

10) Nanak S/o Lal Singh, r/o X-698, Raghuvarpura.

11) Babu S/o Nanak Chand ------------do------------------.

12) Vijay Kumar alias "Gandhi" S/o Nihal Chand, History sheeter P.P. Gandhi Nagar, r/o X-654, Raghuvarpura.

13) Charanji Lal S/o Janjumal, r/o 2187, Raghuvarpura.

8. That the above persons were in front of the mob and some followers were in the back.

9. That I have discussed with my father as he is President, Gurdwara Singh Sabha, Raghuvarpura-I. We had also come from Pakistan.

10. That I send my sisters and parents with family to my neighbour house for escape and self at my own house.

That the following statement for the date 3-11-84:-

1) That on 3-11-84, my servant Mr. Pratap told me at about 11 A.M., that the above named persons are ready to kill you and loot your shop like they are planning.

2) Immediately I sent my family with my aged parents to Camp Gandhi Nagar and self left the house for Jheel Kuranja, there I have two shops at No.755, I A.M. doing the work of auto deal and the other shop is 755A, where I A.M. doing denting painting job where also riots and looting was progress. There my two friends told me to keep off that area also as the circumstances then were not normal. My friend Sharma then carried me to his residence on his two wheeler scooter where I stayed hiding myself for the entire day. I A.M. also the General Secretary of Scooter Market association, Jheel. In the evening Mr. Sharma on my request brought me to my residence at Raghuvarpura. I took my meals with a neighbour. At about 9 P.M., big voices were coming from outside and on watching I found my house doors being broken by abovesaid persons and they were armed with talwars, lathis, iron rods and one of them was holding a gun. On seeing me these persons threw stones on me and also fired gun shots on me when I was watching from the Chajja of my house and on alarm my neighbouring Hindu family escorted me and took me to their residence and kept me under their protection. The matter was not referred to the police because I was being searched by the miscreants. In the morning I found the valuable goods belonging to my family including the managed dowry items of my two sisters betrothed recently looted over by the said persons and I have been left with no alternative or substitute to re-arrange those dowry articles.

11. On 4-11-84, I went to P.P. Kailash Nagar, P.S. Gandhi Nagar, Delhi to report the matter but they without recording my entire statement only recorded "Lootna Chahte Hain" also. When I returned back from P.P. Kailash Nagar, the said persons against forced their entry into my house alongwith a barber and got my hair cut forcibly in neighbouring house. Murari Lal had been instigating those persons and looted my shop and restaurant at X-684, Raghuvarpura, Delhi and also caused fire injuries to me and I then conveyed these riots to police on duty at Chand Mohalla, Gandhi Nagar, Delhi. The police people then extinguish fire with my help. The police said 'Jalao Mat Loot Lo". After police left, these people looted my ration shop bearing FPS No.5845 at X-684, Raghuvarpura, Gandhi Nagar, Delhi. I then went to P.P. Kailash Nagar, Delhi. They refused to report the matter, I then gave my report in writing regarding my two shops. After that, being frightened, I went to Jheel scooter market where my servant Laxman told me that Mohalla people have looted the entire market. Then I went to P.P. Krishna Nagar They also wanted a report in writing. I have then in writing about these two shops.

12. Now also these miscreants above named have been causing threats to me to face dire consequences of looting etc. or to leave the shops and the house also. I have been keeping under my protection aged parents, four sisters of marriageable age. I have suffered a loss of approx. Rs.2,50,000/-. On 25-7-85, I have also represented to the Hon'ble Prime Minister, the Hon'ble Home Minister, Lt. Governor, DCP (East), SHO Gandhi Nagar, but to no effect. My financial condition is very grave. I have not been granted any compensation or claim.

In the circumstances, it is requested that my case may be considered sympathetically and necessary help in the form of claim, compensation, legal protection be also granted.

Proof in support of my submission may be given in the event when it is required.
