1984 Delhi Sikh Genocide - Affidavits

Affidavit submitted before the Misra Commission

I, Kirpal Singh Chawla S/o of Late Jathedar Ladha Singh, R/o WZ-235A, Inder Puri, New Delhi-12, do hereby solemnly affirm and declare as under: -

1. That I am residing at the aforesaid address and am an active Congress (I) worker in that area. Congress (I) leaders, Ex-MP Dharam Das Shastri often visited my house and attend our family social functions.

2. That on November 1st, `84, at about 10 a.m., a mob of about 50 persons armed with deadly weapons attacked my house. They indulged in indiscrimate pelting of stone thereby smashing all the glass window panes. They broke open the lock of my one room situated at the ground floor and burnt it. Our two tenants Shri Sareen and Shri Garg (both Non-Sikhs) tried vainly to pacify the mob.

3. That at about 1 p.m., on the same day (i.e. Nov.1st 1984) a strong mob of about 5000 – 6000 persons all armed with deadly weapons like knives, spears, iron rods, swords etc. again attacked my house. The mob was being led by the following: -

1) Narinder Singh Bisht S/o Dungar Singh Bisht, R/o WZ Block Inder Puri, Delhi.

2) Rajinder Singh Bisht S/o Dunger Singh Bisht, R/o WZ-Block Inder Puri, Delhi.

3) Bawa Bisht S/o Dunger Singh Bisht, R/o WZ Block Inder Puri, Delhi.

4) Mahesh Yadav S/o Bhoor Singh (brother of Brahm Yadav Councillor Congress (I) Village Todapur P.S. Rajinder Nagar, Delhi.

5) Hem Chander and his son, R/o Village Desghara Near Inder Puri, New Delhi, a local BJP worker.

6) Babli son of Babu Ram, R/o WZ-241/EB, Inder Puri, New Delhi.

7) Ishwar Singh (A driver in Delhi Transport Corpn.), R/o Village Dasghara, Inderpuri, Delhi.

I even now recognize them if produced before me.

Mahesh Yadav was leading the mob in a jeep and inciting them to kill every Sikh in India. He was carrying petrol tins in his jeep. Hem Chander was leading the mob in a motorcycle (Bullet Royal Enfield) and had a gun in his hand.

4. That I alongwith my other family confined ourselves to a small room in the top floor of our house and from that place I could see the mob, the leaders leading the mob and various actions of the mob. I know all the persons stated in para 3 above personally. I do not know the names of other members of the unlawful assembly but I can recognize them and identify them if shown to me.

5. That the mob was having crude petrol bombs with them. They threw petrol bombs, brickbats etc. at my house and set it on fire which was destroyed completely. Many gunshots were fired by Hem Chander and my house still has the marks of these bullets.

6. That my family members escaped through the back door and sought refuge with the neighbours. I myself had to get my haircut to escape notice of the mob and thus saved my life. However, we did defend ourselves from the mob by firing shots as my brother S. Jagjit Singh has a licensed revolver and a double barrel gun.

7. That the police did not lodge my report as they made a case against me u/s 302, 307 read with section 34 IPC.

8. That I did reveal the name of the principal accused persons stated in para 3 above but no action has so far been taken against them.

9. That the mob brought to our colony by DTC buses.
